Trademark Registration Timeline in India: How Long It Actually Takes

A clean, uncontested trademark application in India typically takes 12 to 18 months from filing to registration, opposition or examination objections can push this well past 2 years.

Filing a trademark application in India is fast, often same-day, and grants provisional "TM" usage rights immediately upon filing. Full registration is a longer process: examination typically takes 6 to 12 months, followed by publication in the Trademark Journal for a 4-month opposition window, and if uncontested, registration follows shortly after. End to end, a clean application, no examination objections, no third-party opposition, realistically takes 12 to 18 months.

Examination objections (typically on distinctiveness or similarity to existing marks) are common enough that budgeting for at least one response cycle is realistic, this alone can add 3 to 6 months. Opposition, if a third party contests the mark during the publication window, extends the timeline much further, sometimes 2 to 3 years if it proceeds to a full hearing.

The practical takeaway for foreign companies entering India: file the trademark application as early as possible in the market-entry process, ideally before or alongside incorporation, since the provisional rights from filing are valuable even while full registration is pending, and the multi-year potential timeline means "we'll register it once we're operational" often means operating unprotected for a long stretch.
