EOR Compliance Risk: What to Check Before Choosing a Provider in India
Not all EOR providers in India are equally compliant, misclassification and statutory contribution shortfalls create liability that can fall back on the client company.
The EOR model only works as advertised if the provider is genuinely handling statutory compliance correctly, PF and ESI contributions actually remitted on time, labour law requirements actually followed, correct employment classification maintained. A provider cutting corners on any of this creates real liability exposure, and in some circumstances that liability can extend back to the client company, not just the EOR entity, particularly around misclassification disputes.
Before selecting an EOR provider, worthwhile diligence includes: confirming the provider's own registrations and compliance history are in good standing, understanding exactly how statutory contributions are calculated and verified, and clarifying indemnification terms in the EOR agreement for compliance failures on the provider's side.
Price alone is a poor signal for EOR quality in India, a materially cheaper per-employee fee sometimes reflects the provider cutting corners on statutory contributions or benefits administration rather than genuine operational efficiency, worth specifically probing during vendor selection rather than assuming.
