Employment visa or business visa - which one applies
A business visa covers activities such as meetings, exploring opportunities and attending to a group's business interests. It does not permit taking up employment in India or drawing an Indian salary. An employment visa is required where the individual will work for an Indian entity, and is granted against a specific role and employer. Attempting to run genuine employment on a business visa is a recurring and serious error - the categories are not interchangeable, and conversion within India is generally not available.
Eligibility and the salary threshold
Employment visas are directed at skilled and qualified personnel, with a minimum annual remuneration threshold applying subject to defined exceptions for certain categories. The role should be one for which suitably qualified Indian candidates are not readily available, and documentation should support that position. Applications tend to fail where the role description is generic or where remuneration is structured in a way that obscures whether the threshold is met.
Timelines by nationality, and what causes delay
Processing time varies considerably by nationality and by the mission handling the application, ranging from a straightforward exercise to one requiring additional clearance and materially more time. Document authentication in the home country is frequently the longest element. Where a start date is fixed, work backwards from it with real margin, and confirm authentication requirements before assuming a standard timeline applies.
FRRO registration - the step people forget
Foreign nationals on long-term visas must generally register with the Foreigners Regional Registration Office within a defined period after arrival. This is a post-arrival obligation distinct from the visa itself, and missing it creates complications on exit and on subsequent extensions. Dependants have their own registration requirements. Extensions must be applied for before expiry, and lapsed status is considerably harder to remedy than to avoid.
