How does an India subsidiary legally terminate an employee?
For performance or conduct-based termination, India expects a documented process: a clear record of the performance issue or misconduct, a reasonable opportunity for the employee to respond or improve (often via a performance improvement plan or show-cause notice), and only then termination with the contractual notice period or pay in lieu. Skipping straight to termination without this trail is what typically turns a routine exit into a wrongful termination dispute, even when the underlying performance concern was legitimate.
For redundancy or restructuring-driven termination (retrenchment), the Industrial Disputes Act imposes additional requirements for workmen — typically one month's notice or pay in lieu, retrenchment compensation of 15 days' average pay per year of service, and in some cases prior government approval for larger establishments. Full and final settlement in any termination scenario should include unpaid salary, encashment of accrued leave, gratuity if the employee has completed 5 years of service, and any other contractual dues — delayed or incomplete settlement is itself a common trigger for labour disputes even when the termination decision itself was sound.
